These Store and Membership Terms ("Commerce Terms") apply when you buy merchandise or paid membership access from Spicy Friends Ltd., an Ontario corporation ("Spicy Friends," "we," "us," or "our"). They supplement and form part of our Terms of Use. Our Returns, Refunds, and Cancellations Policy, Shipping and Delivery Policy, and Privacy Policy also apply.
If these Commerce Terms conflict with the Terms of Use about a purchase, these Commerce Terms control for that purchase. Mandatory consumer rights continue to apply.
These Commerce Terms apply only to merchandise and paid membership access sold by Spicy Friends. They do not apply to goods, services, events, or other offerings listed by members in Vendor Market, or to any payment, booking, shipping, return, or dispute between you and a listing owner. Those listings are governed by the Terms of Use (Section 13.1).

We currently offer purchases to customers in Canada and the United States. Products, membership plans, delivery locations, and payment methods may vary by location.
2. Products and availability
Product images, colours, measurements, materials, sizing, and descriptions are provided to help you make a purchase. Screen settings and manufacturing variations can affect appearance. We may correct errors, limit quantities, withdraw products, or reject orders before acceptance.
Merchandise is intended for personal use and lawful resale only where we expressly agree in writing. You must not use our name, logos, or merchandise in a way that suggests sponsorship or endorsement.
3. Prices, currency, taxes, and duties
The checkout will identify the transaction currency. Prices are shown in Canadian dollars (CAD) unless the checkout clearly states United States dollars (USD).
Before you submit an order, we will show:
- the goods or membership being purchased;
- quantity, term, and profiles covered, where applicable;
- item or membership price;
- mandatory non-government charges, including shipping;
- estimated taxes; and
- the total amount due and transaction currency.
We do not add undisclosed mandatory service fees. Government-imposed sales taxes may be calculated based on the delivery or billing location. For cross-border merchandise, the recipient may be responsible for import duties, brokerage fees, and local taxes that are not collected at checkout, unless we state that those amounts are included.
4. Placing and accepting an order
Your submission is an offer to purchase. Before submitting, you must have an opportunity to review the purchase, correct errors, accept or decline the agreement, and affirmatively accept the applicable legal terms.
An automated request or acknowledgement does not necessarily mean we accepted the order. We accept a merchandise order when we send an acceptance or shipping confirmation, and a membership purchase when we confirm payment and activate access. We may reject or cancel an order for availability, pricing errors, suspected fraud, legal restrictions, payment failure, or violation of our policies. If we cancel after receiving payment, we will return the amount paid for the cancelled portion using a lawful and reasonably available method.
We will provide a retainable written confirmation of an accepted online purchase, normally by email. Keep that confirmation for your records.
5. Current payment method: Interac e-Transfer
At present, we accept Interac e-Transfer in CAD from Canadian financial institutions only, unless the checkout expressly offers another method.
- Follow the payment instructions and include the requested reference message or identifier.
- Your financial institution and Interac process the transfer. We do not receive your online banking credentials.
- An order or membership is not paid until we verify receipt and match the transfer to the correct request.
- Manual verification may take several business days.
- Interac e-Transfer does not create recurring billing. We will not automatically debit your bank account.
Merchandise cannot be shipped to a United States customer through Interac e-Transfer unless the checkout expressly permits that order and provides applicable delivery terms.
6. Future card payments
We do not currently accept payment cards. A reference in these Commerce Terms to card processing applies only if a checkout later displays card payment as an available method.
When cards become available:
- a third-party payment processor and acquiring bank will process card data;
- we will identify the amount, currency, payment timing, and whether the charge is one-time or recurring before authorization;
- the checkout or receipt will state the merchant or billing descriptor reasonably expected to appear on the cardholder statement;
- you authorize the displayed charge after reviewing the order and accepting the applicable terms; and
- processor, card-network, fraud, and authentication requirements may apply.
Do not use a card or account without the account holder's authorization. Contact [email protected] promptly about an unrecognized charge.
7. Merchandise
Shipping estimates, delivery restrictions, address responsibilities, and delayed-shipment rights are in our Shipping and Delivery Policy. Returns and refunds are governed by our Returns, Refunds, and Cancellations Policy.
Risk of loss and title pass only as permitted by applicable law and the delivery terms shown for the order. Nothing in these Commerce Terms excludes statutory warranties or remedies that cannot be waived.
8. Current paid membership access
Our current paid Supporter offering is a one-time, prepaid purchase for the fixed term shown at checkout. It does not renew automatically. Access begins only after we verify payment and activate the selected profile or linked profiles.
When the prepaid term ends, paid features stop unless you make another purchase. Features, prices, and limits for future purchases may change. We will use reasonable efforts not to materially reduce the core paid benefits during a term already purchased, except where required for legal, safety, security, or operational reasons.
9. Future monthly and annual subscriptions
We do not currently offer recurring subscriptions. This Section applies only if a future checkout clearly labels a plan as automatically renewing and you separately and affirmatively consent to recurring charges.
Before enrollment, the checkout will clearly disclose the plan, profiles covered, price, currency, billing frequency, first charge date, renewal term, cancellation method, and any material limitations. We do not plan to offer free trials.
If you enroll:
- monthly plans renew each month and annual plans renew each year until cancelled;
- you authorize the processor to charge the payment method on file at each renewal;
- we will send a retainable confirmation with the recurring terms and cancellation instructions;
- you may cancel online using a method at least as easy as online enrollment;
- cancellation stops future renewals and normally takes effect at the end of the paid billing period;
- access continues through that period unless the account is terminated for cause; and
- partial-period refunds are not provided except where our refund policy or applicable law requires one.
We will provide legally required reminders, including an annual reminder for an active automatically renewing plan and notice between 15 and 45 days before an annual renewal. We will give advance notice of material price increases before the higher charge and explain how to cancel. We will obtain renewed consent where applicable law requires it.
Deleting an account, removing an app, or ceasing use does not itself cancel recurring billing. Use the online cancellation control or contact support. We will not create unreasonable barriers or require you to listen to retention offers before cancellation takes effect.
10. Promotions
Promotional terms shown with an offer apply in addition to these Commerce Terms. Promotions may have eligibility, quantity, territory, and expiry limits. We will not enroll you in recurring billing through a promotion unless recurring terms are clearly disclosed and you separately consent.
11. Fraud, reversals, and disputes
We may delay fulfillment, request reasonable verification, reject an order, or suspend commerce access where we reasonably suspect fraud, unauthorized payment, sanctions concerns, or abuse.
Contact us first so we can investigate a billing or fulfillment problem. This does not waive any right to dispute a charge with your financial institution. Knowingly making a false payment dispute or using stolen funds may result in account action and recovery of amounts lawfully owed.
12. Changes
We may update these Commerce Terms for future purchases by posting a revised version and effective date. Terms presented when an order or subscription is accepted continue to govern that transaction, except where a lawful change is properly disclosed and accepted.
