Legal Requests

This page is part of the Privacy Policy and the Terms of Use. It is written for law-enforcement and government agencies, for lawyers serving process, and for members who want to understand when we disclose information.

Spicy Friends Ltd. is an Ontario corporation. Members trust us with intimate and private data. We disclose non-public personal information only as described here and in the Privacy Policy.

This is a general guideline. Information available varies by account, by what the member chose to share, and by our retention practices. Some fields are optional. We may not have collected or kept the information sought.

1. Information we may hold

This is a non-exhaustive list of data we may maintain about a member, or that a member may share with others on the Service.

Public or other-member-visible data (depends on privacy settings)

  • Profile display name, age derived from date of birth, location the member chose to show, and other profile fields
  • Relationship and seeking information the member posted
  • About text, websites, and similar profile content
  • Public activity, posts, comments, reviews, and media the member set to be visible
  • Event, place (including map location, published contact details, and Supporters-only or similar visibility settings), group, publication, Vendor Market (including items, published contact details, and location), and rendezvous listings or RSVPs the member made visible
  • Connections the member made visible (for example friends, followers, or similar)

Non-public account data

  • Email address
  • Date of birth (self-reported) and partner/couple profile dates of birth the member provided
  • Account creation date and account status
  • Private or limited-audience Content (including private albums and messages)
  • Blocks, reports, and related safety records
  • Support correspondence
  • Profile-verification materials (see the Privacy Policy)
  • Limited payment metadata for Supporter purchases (see the Privacy Policy)
  • Merchandise order, shipping, return, refund, tax, and customer-support records
  • If card payments launch, processor references, limited card metadata, recurring-consent and cancellation records, and chargeback or fraud records
  • Points ledger entries associated with the profile
  • Browser, device, and IP information subject to our retention limits

Other data

  • Server logs and encrypted backups, each subject to our retention policy
  • Analytics events, only if the member opted in to analytics cookies
  • Records we preserve under a legal hold (Section 5)
  • Content complaint, takedown, depicted-person appeal, and available consent or age/identity compliance records, subject to our retention practices

2. When we disclose non-public information

It is our policy to disclose non-public member information in connection with a criminal or civil investigation only:

  • with the member's consent, after we are satisfied of the member's identity (we may provide the information to the member, or to a designated third party with the member's written authorization); or
  • upon receipt of valid compulsory legal process that we are required to follow under applicable law—typically a production order, court order, search warrant, or similar process issued by a Canadian court or other Canadian authority with jurisdiction; or
  • in a qualifying emergency, as described in Section 4; or
  • as otherwise required by law (for example a statutory duty we cannot lawfully refuse).

We reserve the right to object to requests that lack proper authorization, that are overbroad, or that we believe are improper. Where we agree or are required to produce information, we will conduct a reasonable search for what the request specifies.

Foreign process. Spicy Friends is based in Canada. We generally expect foreign criminal or civil process to be domesticated in Canada (for example through mutual legal assistance, a letter of request, or an Ontario court order) unless applicable law requires us to respond directly. We may still preserve records (Section 5) while that process is underway.

Civil matters. Serve civil process through the courts of Ontario, Canada, unless another Canadian court has jurisdiction we are required to respect.

What we typically produce, depending on the process

These examples are a guide, not a promise that every record exists.

  • With verified member consent: private account information the member is entitled to obtain, as described in the Privacy Policy.
  • With a valid production order, court order, or similar compulsory process: non-public account records such as signup date, email address associated with the account, and IP addresses used to access the account at a specified time relevant to the investigation, plus limited-audience Content where the process lawfully requires it.
  • Commerce records: order and transaction records responsive to valid process, excluding full card details that we do not hold. A payment processor, financial institution, carrier, or fulfillment provider may hold additional records and should be addressed directly where appropriate.
  • Contents of private communications (messages between members, and private conversations with Spicy Friends, including verification media): we will not disclose these unless compelled by a search warrant or equivalent court order that lawfully requires production of communications content, or in a qualifying emergency, or with the member's consent.

We will not disclose account access logs that would reveal a user's movements over a period, or member-specific browsing history, except where compelled by a court order or warrant that meets the applicable legal standard, or in a qualifying emergency.

3. Member notice

It is our policy to notify affected members about a pending request for their information, unless we are prohibited by law or court order, or in rare exigent circumstances (including Section 4).

Before disclosing member information in response to legal process, we will make a reasonable effort to notify affected members at the email address on the account and, where we may do so, to provide a copy of the subpoena, order, or warrant so they can seek to challenge it.

4. Emergency and exigent circumstances

We may—but are under no obligation to—voluntarily disclose information, including contents of communications and customer records, to a national, provincial, territorial, state, or local governmental entity if we believe in good faith that an emergency involving the imminent danger of death or serious physical injury to any person requires disclosure without delay.

We evaluate emergency requests case by case. If we receive information that gives us a good-faith belief that such an emergency exists, we may provide information we have that is necessary to prevent that harm.

Emergency requests should say that they are an emergency, describe the imminent harm, identify the member as specifically as possible, and come from an official agency address.

5. Preservation requests

We will take reasonable steps to preserve specified account records for up to 90 days upon a formal written request from law enforcement in connection with an official criminal investigation, pending issuance of a court order or other compulsory process. We may extend a preservation once for another 90 days if the requesting agency asks in writing before the first period ends.

Preservation is not disclosure. We still require valid process (or a qualifying emergency, or member consent) before we produce preserved records.

6. Testimony and cost

Spicy Friends does not provide expert testimony as a routine matter. Account records are business records. If a particular form of certification is required, attach it to the request.

We reserve the right to seek reimbursement from the requesting agency for administrative costs outside our ordinary business practices, as allowed by law.

7. How to submit a request

Make requests as specific and narrow as possible, and include:

  • the authority issuing the request;
  • name and badge or identification of the responsible agent;
  • a valid official return email address;
  • the member's profile name and URL (if you cannot locate those, a phone number or email address associated with the account, if you have one);
  • URLs of any specific pages or Content of interest;
  • the types of records sought and the relevant date range; and
  • whether you can receive production through a secured transfer link.

Please allow at least two weeks for us to review a routine request, longer if the request is broad or if we object. Emergencies (Section 4) should be marked as such in the subject line.

Do not send child sexual abuse material as attachments. Report those issues as described in Content Complaints and Appeals.
