1. Jurisdiction and voluntary disclosure
The Service is operated by Spicy Friends Ltd., an Ontario corporation based in Guelph, Ontario, Canada. The Service does not, by itself, place Spicy Friends under the jurisdiction of the United States.
This page is provided so that people who are bound by those United States record-keeping rules can understand our role as a host of third-party content. By publishing this page, Spicy Friends does not acknowledge United States jurisdiction over it, and does not attorn to the courts of the United States. Disputes with Spicy Friends are resolved as described in the Terms of Use (Ontario law and the forums stated there).
2. We are not a producer of User Content
Spicy Friends does not produce, direct, or commission the sexually explicit User Content on the Service and does not manage performers. Members upload, post, and message visual depictions on their own, on areas of the Service under member control.
Our role is limited to hosting, storing, transmitting, retrieving, formatting, and displaying User Content so the Service can function. To the extent 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75 apply to a depiction, we are not a "producer" of member-uploaded material within the meaning of 18 U.S.C. § 2257(h)(2)(A). Hosting and related activities of the kind described in 18 U.S.C. § 2257(h)(2)(B)(v) (and parallel language in § 2257A) are the better description of what we do.
Spicy Friends is not the custodian of performer age or consent records for User Content. If those record-keeping rules apply to Content you produce, you are responsible for creating and keeping the required records.
3. Age, consent, and member duties
Eligibility, uploader warranties (including adult age and informed consent of every depicted person), and enhanced content-provider controls are in the Terms of Use (Sections 2, 4, and 8). If you cannot make those warranties, do not post the Content.
We may require age assurance, remove or restrict Content, or preserve material when the law requires it. Support review and automated screening are not a guarantee that every depiction is lawful or that every depicted person is 18.
4. How we handle violations
Our primary obligation as a host is to restrict or remove Content that violates our rules or the law when we identify it. Members can report Content using in-app tools. We may also act on our own review.
